Rambert (“we”) is committed to protecting the privacy of our customers, suppliers, contractors, and staff in accordance with the Data Protection Act 2018 (DPA 2018), UK General Data Protection Regulation (UK GDPR) and the Privacy and Electronic Communications (EC Directive) Regulations 2003 (PECR).

This privacy notices tells you what to expect us to do with your personal information if you contact us or use one of our services.

Ballet Rambert Limited is the Data Controller (ICO registration ZA178841) for the personal information we process.

What information we collect

We only collect the information that is necessary to carry out normal business operations, to process your bookings and orders and to provide you with the services, products, or information you have requested.

Examples of the type of personal information that we collect includes:

  • Name, title
  • Date of birth, gender, nationality,
  • Contact details including postal address (including country), email address and telephone numbers
  • Access and medical requirements (where applicable)
  • Your preferences about what content you would like to receive from Rambert as well as your cultural segment preferences. These are optional.
  • Transaction history, including financial and credit/debit card information, donations and Gift Aid declarations.
  • Technical information gathered when you visit our website; including the Internet protocol (IP) address used to connect your computer to the Internet.
  • Information about your visit to our website and Rambert Home Studio including what pages you accessed and when and how many videos you watched.
  • Online analytics that assist us in the improvement and optimisation of our website.

Email, web activity and social media

At the point of sale (when you subscribe to Rambert Plus as a service), you automatically consent to receive email communications from Rambert.

We keep a record of the emails we send you, and we may track whether you receive or open them so we can make sure we are sending you the most relevant information. We may also track any subsequent actions, such as click through actions and unsubscribes.

We receive and store certain details whenever you use the Rambert website. A cookie records on your device information relating to your internet activity (such as whether you have visited our website before). You can view our Cookie Policy here.

We use social media to broadcast messages and updates about events and news. On occasion we may reply to comments or questions you make to us on social media platforms. You may also see adverts from us on social media that are tailored to your interests. Depending on your settings or the privacy policies on social media and messaging services like FacebookLinkedInInstagram or Twitter, you might give third parties (like Rambert) permission to access information from those accounts or services.

How we collect information

We will use personal information supplied by you only to process your bookings and orders and to provide you with the services, products, or information you have requested.

We may obtain personal information about you when you:

  • Use our website
  • Contact us about products and services
  • Make a donation or purchase
  • Register to receive emails or other communications from us
  • Sign up to Rambert Plus

What we do with your information

We will only collect the personal data that we need and use it according to the relevant lawful purpose(s) as permitted by current data protection legislation.

We will not share, sell, or trade your personal information with any third parties (except for the purpose of providing the services you have requested, or with law enforcement authorities if and when an applicable legal process is followed).

We will use the information to:

  • Process your bookings and orders and to provide you with the services, products, or information you have requested. We may need to share your information with our service providers and agents for these purposes. In such cases, appropriate data sharing agreements will be in place.
  • Carry out our obligations arising from any contracts between us and provide information, products, and services you have requested from us.
  • Ensure we know how you prefer to be contacted.
  • Provide information about products and services we offer.
  • To contact you about changes to our products and services.
  • To contact you about fundraising.
  • Analyse donor or customer information.
  • Analyse the personal information that you and others provide in order to obtain a better understanding of our audiences and improve the services that we have on offer.
  • Analyse your personal information to create a profile of your interests and preferences so that we can contact you with information relevant to you.
  • Analyse Rambert Plus users to understand who subscribes to classes, as well as who attends live streams.
  • Invite you to take part in customer research in order to help us understand and improve our products and services.
  • If we have a legal obligation e.g., DBS checks, keeping records for HMRC etc.
  • If we have a vital interest.
  • If we need it to perform a public task.

Sharing your data with third parties

We will not share any personal details with any other third parties without your agreement, unless required in order to fulfil our contract with you or allowed by law.

In general, the third-party providers used by us to fulfil our contract with you will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

These providers include, but are not limited to:

  • Patronbase – our CRM system provider
  • Klaviyo – our email distribution service
  • Book When – where users can book and pay for on-site classes
  • Windcave – to collect payment for online classes on Rambert Plus
  • People’s Fundraising – to collect donations
  • Sage – our accounting software.

We have agreements in place with each to ensure that your data is secure at all times and cannot be accessed or used for any other purpose.

We may share personal information with other organisations, particularly The Audience Agency, who use this to analyse ticket sales for national and regional research into patterns of Arts attendance in England. This assists with reporting to funders and strategic planning, helping us to make better business decisions. Your personal data is never used by them to contact you, nor passed or sold on to any other agencies or companies, and we have agreements in place to ensure this.

We use Counting What Counts as our Processor to power selected evaluations each year. We have signed a legally binding agreement with Arts Council England confirming CWC will only collect and store information about you according to our instructions, based on how we use their self-serve platform. CWC has taken steps to minimise the amount of personal data it can see or access when processing on our behalf and to make sure it’s appropriately secured. See the CWC Privacy Policy.

How we store your data

Your personal data will be securely held and processed on the Rambert systems or systems managed by suppliers on behalf of Rambert. We maintain a customer relationship management (CRM) system to hold contact details and a record of your interactions with us such as merchandise purchases, queries, complaints, and attendance at events etc. Where possible we aim to keep a single record for each donor/customer.

We will always seek to hold your data securely. Access to donor/customer information is strictly controlled and can only be accessed by people who need it in order to do their job. Certain data, for example sensitive information, is additionally controlled and is only made visible to members of staff who have a reason to work with it.

If you have provided credit card details, these will only be used for the purpose of handling an individual booking or order and will not be stored.

Any payment transactions will be encrypted.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

We may need to disclose your details if required to by the police, regulatory bodies, or legal advisors.

We will only ever share your data in other circumstances if we have your explicit and informed consent as detailed above.

All information received by us is retrieved using secure technology. In order to provide a safe and secure environment for your personal information we use up to date technology with a view to protecting that information against loss, misuse, or unauthorised alteration.

Data is held by us for as long as is legally or practically necessary for our business. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. We will retain personal data of event attendees, donors and those who purchase merchandise from us, for two years without activity before anonymising it.

Once that necessity is past, we have a regular programme of data anonymisation. This ensures that your data is not held indefinitely on our systems.

Lawful bases for processing

Under the UK GDPR, the lawful bases we rely on for processing this information are.

  • We have a contractual obligation e.g. fulfilling and dispatching orders, to provide you with the services, products or information you have requested. To process your bookings and orders and to provide you with the services, products or information you have requested. We may need to share your information with our service providers and agents for these purposes.   • We have a legal obligation e.g. DBS checks, keeping records for HMRC.
  • We have a legitimate interest e.g. undertaking research, analysing donor/customer information. We also analyse the personal information that you and others provide in order to obtain a better understanding of our audiences and improve the services that we have on offer. While we cannot guarantee the security of the internet, this website has security measures in place to protect against the loss, misuse and alteration of any information you provide us.
  • We have a vital interest.
  • We need it to perform a public task.

Your data protection rights

Under data protection law, you have the following rights including:

  • To be informed about the ways in which we use your personal information.
  • To request access to personal data we hold about you.
  • To request us to rectify any inaccurate data we hold about you or to complete information you think is incomplete.
  • To ask us to erase your data (also known as The Right to be Forgotten).

  • To require us to provide data portability of your information. This allows you to move, copy or transfer personal data easily from one IT environment to another in a safe and secure way, without affecting its usability. This only applies to information you have given us and only applies if we are processing information based on your consent or under, or in talks about entering into a contract and the processing is automated.
  • To ask us to stop using your information, for example to stop sending you marketing emails. Every email Rambert sends you has a clear unsubscribe button and you can opt out of emails by clicking this.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

Giving you control over your account

We try to make it as easy as possible for you to tell us how you’d like to hear from us. You can withdraw your consent at any time by emailing [email protected] or selecting the unsubscribe button at the bottom of all our email communications.

You can also update your own preferences by logging into your Rambert Plus account.

Subscribers to Rambert Plus can cancel their class subscription (no matter how long they have kept their subscription) by providing at least a 4-day notice period to when their next billing date is due.

After a class subscription is canceled and you have been notified that it has been done so, you will remain a free member of Rambert Plus unless you instruct us by emailing [email protected] to remove all your data from our CRM system provider.

If you have opted out of marketing communications, we may still get in touch with you. For example, we may email you to give you important information about the events you have booked that will take place after you decided to opt out or to tell you about any relevant changes.

How to complain

We are committed to managing any complaints effectively and efficiently. Our Director of Audiences is accountable for the Complaints Management Process and responsible for coordinating the resolution of complaints and any subsidiary issues by liaising with the relevant and responsible staff.

Comments and feedback are very important and help to improve our services. We encourage anyone who uses Rambert’s services or facilities to comment on their experience and we will respond in a professional, consistent, accurate and honest way. We will reply to you using your preferred method of communication and aim to do so within 10 working days. If this is not possible you will be kept informed.
